Everfresh Endeavors, LLC d/b/a Lime Fresh Mexican Grill and its franchisees, affiliates and subsidiaries (collectively, “Lime Fresh”) is committed to protecting your privacy. This privacy policy (“Policy”) applies to any website or application that we own or operate that links to this Policy, including any interactive features or services (collectively, the “Sites”). This Policy describes the types of information we may collect from you or that you may provide when you visit our Sites and our practices for using, maintaining, protecting and disclosing that information.
Please keep in mind that our commitment to meeting the needs of our users may result in changes or additions to this Privacy Policy. We may modify or supplement this Privacy Policy from time to time. If we decide to change this Privacy Policy, we will post those changes on this page.
By visiting our Sites, you are accepting the practices described in this Policy. If you do not agree to the terms of this Policy, please do not use or download the Sites. This Policy is governed by the laws of the United States and by agreeing to this Policy you agree to the transfer of your information as required by law, court order, or as requested by government or law enforcement agencies.
This Policy does not apply to information that you may submit to us offline, or to websites maintained by other companies or organizations to which we may link or who may link to us. We are not responsible for the actions and privacy policies of third party websites.
What Information We Collect and How We Use It
We do not knowingly collect personal information on individuals under the age of 13 without parental consent.
If you choose to establish a Lime Fresh Lime Lovers loyalty account, you will be required to provide some information, such as your name, email address, birth month, and mobile phone number. You will have the option to provide additional information and edit that information in your profile. We use the information you supply for the purpose of providing the services you have requested, and as described in this Policy. In addition, we may from time to time contact you via email or regular mail about new products, services, content, or information that we think may be of interest to you. You can opt-out of certain communications by electing to “Unsubscribe” from emails or by editing your personal profile by checking the “opt-in/opt-out” box as appropriate.
We may also provide members the opportunity to receive news, promotions and other information via email from Lime Fresh, franchisees and active partners. You will only receive these emails if you grant us or the merchant permission to communicate with you. You must also provide us or the merchant with at a minimum your name and email address to allow us to communicate a personalized message to you.
If you shop with us, you will need to provide your name, address, phone number(s), email address, billing information (including credit/debit card number and expiration date), and, if applicable, the names, addresses, and phone numbers of gift recipients to a third party credit card fulfillment service which will use this information to process and fulfill your order or as otherwise described in this Policy. We will not contact gift recipients using any of the information that you provide to us.
You may, now or in the future, have the option to provide other information to us, such as your date of birth, your favorite store, ordering preferences or favorites, allergen or other dietary information, or other information that you choose to provide. We may use this information, including information that personally identifies or reasonably could identify you (“personally identifiable information”), collected by or provided through the Sites to improve our services, products, and operations; customize content and experiences on our Sites; perform statistical, demographic, and marketing analyses; fulfill orders and other requests for products or services; contact you about our products, services, and events; provide you with information that you have requested or that we think may be of interest to you; or for other business operations and support.
In certain instances, we may use or disclose your personally identifiable information to identify, contact or bring legal action against persons or entities who may be causing injury to you, Lime Fresh, or others; detect, investigate, and prevent fraud and other unlawful activities; protect and defend ourselves, our property, our employees, our customers, and our users; conform to applicable law or comply with our legal requirements or legal process served on us or the Sites; or act under emergency circumstances to protect the personal safety of us, our affiliates, agents, or the users of the Sites or the public. In the event of a merger, consolidation, sale, or transfer of all or substantially all of our company or its assets, information collected by our Sites may be transferred to the purchaser or the new company. Under such circumstances we would, to the extent possible, require the acquiring party to follow the practices described in this Policy, as it may be amended from time to time. Nevertheless, we cannot promise that an acquiring company or the merged company will have the same privacy practices or treat your information in the same manner as described in this Policy.
We may use or disclose information that does not directly identify you, including but not limited to aggregate data about your use of the Sites or our services in any manner we deem appropriate or necessary.
When you interact with any of our social media accounts or pages, we may collect personally identifiable information that you provide or make available through that page or site. The social media site’s privacy policies will apply to the collection, storage, and sharing of information through the social media site. If you choose to link or login to your Lime Fresh account with or through a social networking service, Lime Fresh and that service may share certain information about you and your activities. With your consent, we also may share information about your activities, including what you view on the Sites, with that social network’s users.
Location Information
When you download or access certain features of the Sites, such as our mobile application, we may collect information about your location. You can disable this process by changing the settings pertaining to our mobile application on your mobile device. We may use your location information to provide you with information on products and services that you request, including processing your orders and sending you information about your orders, and personalize content and experiences on our Sites, including providing you with recommendations, information, and offers about our products and services. We also may use your location information to optimize or improve our products, services, and operations, perform statistical, demographic, and marketing analyses, and detect, investigate, and prevent activities that may violate our policies or be illegal.
Use of Cookies
Our Sites may use cookies and other tracking technology, such as web beacons, to help us determine whether a visitor to our Sites has visited our Sites before or if he or she is a new visitor. Cookies may also allow Lime Fresh account registrants to save time during checkout on return visits. Most web browsers automatically accept cookies, but you can usually modify your browser settings to reject or disable the use of cookies. Please note that if you disable or delete cookies, certain aspects of our Sites will not function properly, such as the ordering. Our cookies do not track any personally identifiable information about you or provide us with any way to contact you, and the cookies do not extract any information from your computer.
We may use third-party analytical tools to help us better understand how you use our Sites. These analytical tools place cookies or other tracking technology on your computer or device to collect information about your activity related to, and usage of, the Sites. The information collected by these analytical tools tells us things like which search engine referred you to our Sites, how you navigated around our Sites, what you purchased, and other information related to the Sites activity and usage. This information helps us to better serve you with more personalized information and product offerings. In the event a third-party provider of analytical tools will have access to your personally identifiable information, such as your name, address, phone number or precise location, we contractually require such third-party provider to limit its use of your personally identifiable information to perform services for us and to maintain all of the information it collects and analyzes for us securely and in confidence. Such third parties may not share your personal information with anyone else, or use it for any other purpose, except on an aggregate, non-identifiable basis.
We also may partner with third-party advertising companies who may utilize cookies or other tracking technologies, to collect information about you when you use the Sites. These cookies and other technologies may be used to provide advertisements about goods and services that may be of interest to you. These third parties may collect information about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based advertising or other targeted content. These partners do not have access to or use your name, address, email address, telephone number or other personally identifiable information from us. They may, however, use persistent identifiers to anonymously track your Internet usage across other websites in their networks beyond our Sites. Such third parties may, with sufficient data from other sources, be able to personally identify you, unknown to us. We do not control these third parties’ tracking technologies or how they may be used. Your browser or device may include “Do Not Track” functionality. Because a “Do Not Track” protocol has not yet been finalized, Lime Fresh’s information collection and disclosure practices will continue to operate as described in this Policy, whether or not a Do Not Track signal is received.

Third-Party Service Providers
We sometimes employ other companies and individuals to perform services for us. For example, we may hire agencies to help administer consumer promotions, to analyze data, to process, fulfill and deliver orders you place, and to provide customer service. If you would rather not receive marketing mail or emails from us, please let us know by unsubscribing to our email communications. Please note that if you opt-out of receiving email marketing messages from us, we may still contact you via mail or email on matters related to services and products that you have requested from us, operation of the Sites, your correspondence with us, changes in policies, and as otherwise described in this policy.
